TERMS AND CONDITIONS
Please read these General Terms and Conditions that apply to the provision of my professional services. By scheduling an appointment, you agree to the following terms and conditions. If you cannot or do not wish to agree to these conditions, you should not schedule an appointment or proceed with the coaching.
FREE INITIAL CONSULTATION
You may be offered a free 15 to 20-minute online initial consultation. No coaching will be provided during the consultation. The purpose of this initial consultation is to determine whether collaboration is sensible. During this conversation, estimates will be provided based on the information available at that time regarding the number of sessions required to address your current issue. The estimates are rough guidelines and may change.
CANCELLATION, RESCHEDULING, AND REFUND
Cancellation and Rescheduling
If you need to cancel or reschedule a session, please inform me as early as possible. Notification must be sent by email or phone at least 48 hours before an in-person session or independently through Calendly at least 36 hours before an online session.
Refunds
Session fees are intended for my time and professional expertise and do not guarantee a successful outcome. As such, refunds for sessions you have attended and paid for are not possible. If you have booked a discount package or coaching program and paid in advance, and you decide to discontinue the coaching process before attending all the sessions, a pro-rata refund will be granted after deducting the full standard session fee for all sessions you attended. Cancellations within 24 hours before a session generally do not qualify for a refund, unless it is due to force majeure.
Challenges: We are committed to ensuring your satisfaction with our services. If for any reason you are not entirely satisfied with the FYSA Challenge, we offer a 10-day peace of mind guarantee. Within this period, you have the option to request a full refund, no questions asked. Simply reach out to us, and we will promptly process your refund.
SESSION FEES
All fees will be disclosed before booking. My fees are subject to review and may increase from time to time. You will always receive a cost confirmation before booking.
Payments
You agree to pay any applicable surcharges on payments made by credit card.
Unless otherwise specified, all amounts on our website are in EUR. The currency and amount will be displayed before you complete your payment. We do not store your financial information on our platform; instead, our third-party service provider, Stripe, handles and retains your payment details for each billing period. PAYMENT OPTIONS
Payment can be made via bank transfer, Stripe, Pay Pal or Credit Card. Cash is accepted for in-person sessions.
CONTACT BETWEEN SESSIONS
Any contact between sessions will occur via phone, email, or Zoom, and only during office hours. Messages received outside of these hours will be processed during office hours. We reserve the right to make appropriate changes to office hours at any time. CEST Time:

MEDICAL OR PSYCHOLOGICAL CONDITIONS
Please note that I cannot provide my professional services if you have epilepsy or any form of psychosis.
I may inquire about your medical history to determine any contraindications for a session. This also helps assess whether your health condition affects or is influenced by the goals of the session(s) you seek. Please inform me of any relevant medical changes that occur during the sessions or if you decide to continue with additional sessions after some time. If you are under the care or treatment of a physician or therapist, such as a general practitioner, psychologist, psychiatrist, or counselor, you may be required to obtain their permission before a session can begin.
AGE RESTRICTIONS
You must be at least 18 years old to participate in online sessions. Clients under 18 years of age must be accompanied by a parent or legal guardian and will be received in person.
PARTICIPATING IN YOUR SESSIONS
Please ensure that you are present at the beginning of your session on time. If you are running late, please notify me as soon as possible. I will do my best to provide you with a full session, but this cannot be guaranteed as it depends on bookings after your session.
HYPNO-AUDIO
Hypno-audios should not be listened to while driving, operating machinery, or engaging in other activities that require concentration. The recordings are for your personal use only and must not be shared, lent, copied, or sold under any circumstances.
RESULTS OF THE SESSIONS
Agreeing to work on the issues or problems you present does not imply or guarantee a solution. No results can or will be guaranteed. I will always do my best and utilize my skills to work towards your goals and intended outcomes.
CODE OF CONDUCT
Throughout the sessions, I will treat you with respect and will not abuse the trust you place in me. I will adhere to best practices in our mutual interest. In return, you commit not to harm yourself or others, including me, or the property of myself or anyone else.
You commit not to attend sessions under the influence of alcohol or other drugs, except for medications prescribed by your physician. If you attend a session under the influence of alcohol or drugs or exhibit violent or abusive behavior, I will cancel the session and may refuse to receive you for further sessions without refunding any payments already made.
CONFIDENTIALITY
All interactions, including sessions, phone calls, and emails, will be treated as confidential and may be recorded. Your consent will be obtained before any recording. All records, conversations, and notes will be kept confidential, except in the following cases:
If you grant permission to breach confidentiality If I am compelled by a court to do so If the information is such that confidentiality cannot be maintained, such as: – There is a risk of harm to yourself or others – In cases of fraud or crime – Involving minors (under 18 years of age) If a referring general practitioner or other medical professional requires a report. A copy of the report is available upon request.
LIABILITY & INDEMNITY
Under no circumstances shall Maximilian Messler Mindset Coaching be liable for damages, including but not limited to direct, indirect, incidental, special, punitive, consequential, or other damages (including, but not limited to lost profits, lost revenue, or similar economic losses), whether in contract, tort, or otherwise, arising from the advice or information provided to you during the professional services provided by Maximilian Messler Mindset Coaching. Additionally, you agree to defend, indemnify, and hold Maximilian Messler harmless from all claims, losses, liabilities, damages, and expenses (including attorney’s fees) arising from your participation in the professional services.
APPLICABLE LAW
These terms and conditions, and all other matters arising out of or in connection with these terms, are subject to the laws of Germany and shall be construed in accordance with them. You agree to submit to the exclusive jurisdiction of the German courts to settle any disputes that may arise out of or in connection with these terms.
UPDATES TO TERMS AND CONDITIONS
These terms may be amended without prior notice. Please familiarize yourself with any changes when resuming coaching with me after an extended absence.
